A bail application by the suspect Nikita Singhania was filed on Monday, and the counsel for her and other accused submitted how and why the bail should not be granted to them.
In a case before a Bengaluru court, the son-in-law of Atul Subhash, who committed suicide alleging that his wife was demanding three crore rupees in the guise of divorce settlement, has sought for rejecting a bail to the accused wife of Atul Subhash, who was represented in court by Akash Jindal.
The bail matter of the accused wife of Atul Subhash, was slated to be heard on January 4 in the Bengaluru court. The bail application by Nikita Singhania was filed on Monday and the counsel for her and the other co-accused argued how and why the accused persons should not be granted bail.
Statement from the Legal counselor of Atul Subhash:
The lawyers of the family of Atul Subhash argued, “This is a matter of a criminal nature that’s accumulating against her, and she cannot make trading of the child to get bail; we have asked for total custody of the child.”
“Our stand is that the crime which they have committed is very heinous. As such, we have filed a habeas corpus petition before the Supreme Court. The court has passed directions to the states of UP, Karnataka and Haryana for ascertaining the whereabouts of the child, and as soon as the child is found, directions would be passed for considering the custody of the child,” he added.
Atul Subhash’s Family’s Argument:
“Why was the 4-year-old kid away from his mother and put in a hostel? The grandparents are worried about the little one,” he said.
Pavan Kumar Modi, the father of Atul Subhash, said they are all concerned about the safety of their child. He feared the wife might attack the child and cause it danger if the court granted her bail. “If she was able to force my son to commit suicide, she can do the same with the child,” he noted.
“My grandson was an ATM to her; she received money under the pretext of taking care of him. She approached the High Court demanding between Rs 20,000 and Rs 40,000. She later claimed for Rs 80,000. Thereafter, she kept demanding more from us. Hence, we have approached the Supreme Court to seek custody of our grandson, as he is safe with us,” he said.
Bikas Kumar, brother of Atul Subhash, said the family was quite happy with the overall investigation carried out by the police department. “The police supported us and asked us to fulfil their requirements and did the investigation accordingly. We have to get custody of the child; we have already informed our advocate about it. The matter is in the Supreme Court,” he said.
On being asked about the child’s whereabouts, he said they do not know where Atul’s son is. “We are waiting for the Supreme Court hearing on this,on January 7,” he said.
Case Brief:
Subhash, who was employed with an automobile company in Bengaluru, committed suicide after being blackmailed for a divorce settlement of Rs 3 crore. On December 9, at his apartment, he took the extreme step after he had completed a video lasting 90 minutes and wrote a 40-page death note explaining how his wife, Nikita Singhania, and her family had harassed him.
The three accused persons in the case dealing with the suicide of Atul Subhash his wife, mother-in-law, and brother-who were arrested by the Bengaluru police were subsequently sent to judicial custody for 14 days.
The police recorded an FIR against the accused under Section 108 and 3(5) of the Bharatiya Nyay Sanhita on 9th December 2020. The complaint was lodged by Bikas Kumar, alleging abetment to suicide, with the Marathahalli police.
In his complaint, Bikas Kumar alleges that the accused filed false cases against his brother (Atul) and demanded Rs 3 Crore to settle the case. In court, his brother was also taunted during the proceedings, that he had to either give Rs 3 Crore or commit suicide.
The family of Nikita alleged that Arul Subhash dangled a hefty dowry in front of his family, which led to her father’s demise.
