Special Court Temporarily Suspends Rape Case Summons for BJP Leader Syed Shahnawaz Hussain

This summons arose from a complaint filed by a woman who alleged rape and criminal intimidation by Hussain. Special judge M K Nagpal issued the stay order in response to a revision petition filed by Hussain, challenging the original order from the magisterial court, which had directed him to appear before it on October 20.

The special judge’s order, dated October 17, not only stayed the summons but also issued a notice to the complainant, requesting her response by November 8. The judge further stated, “In view of the submissions being made by counsel representing the petitioner, it is also being directed that till then, the operation of the impugned order and further proceedings in the case shall remain stayed.”

Hussain’s revision petition argued that the metropolitan magistrate had taken cognizance of the offenses “merely on the basis of a statement under section 164 CrPC made by the prosecutrix, though there is sufficient other oral or documentary evidence on record to show that no such incident of intoxication or rape of the prosecutrix actually took place.” This implies that the petitioner, Hussain, believes there is substantial evidence to disprove the allegations.

Prior to this stay order, the magisterial court had already taken cognizance of the alleged offense and had directed the former Union minister, Syed Shahnawaz Hussain, to appear before it on October 20. The complainant’s allegations centered around her claim that she was administered an intoxicant by Hussain, who then raped her at a farmhouse in the national capital in April 2018.

However, it’s worth noting that the police had previously filed a report before the court, seeking the cancellation of the FIR. In an order passed on October 10, the judge had dismissed the police report, asserting that the issues raised by the investigating officer while filing the cancellation report were matters that could be decided during a trial. This implies that the court believed that the matter warranted further investigation and legal proceedings.

The alleged offenses in question are punishable under various provisions of the Indian Penal Code (IPC), including sections 376 (rape) and 506 (criminal intimidation). It’s important to acknowledge that these are serious charges, and a thorough legal process is crucial to establish the truth.

This case has had a history of legal battles. The Supreme Court had previously dismissed a plea by Hussain, challenging an order from the Delhi High Court for lodging the First Information Report (FIR) and initiating an investigation. The Supreme Court’s decision indicated that all legal remedies available under the law were open to Hussain, emphasizing the need for a comprehensive legal process to determine the veracity of the allegations.

The Delhi High Court had also dismissed Hussain’s plea last year, contesting a trial court order that directed the Delhi Police to register an FIR against him. The high court’s decision was grounded in the belief that there was no perversity in the 2018 order, suggesting that the legal system had found merit in pursuing the case further.

To provide some context, this case originated in 2018 when a woman based in Delhi approached a lower court, seeking the registration of an FIR against Hussain for alleged rape. Hussain, in response, vehemently denied these allegations. Subsequently, a magisterial court had, on July 7, 2018, ordered the registration of an FIR against Hussain, reasoning that a cognizable offense was made out in the complaint. This decision was challenged by the BJP leader before a sessions court, but his plea was dismissed.
