Legal Career and Shift to Criminal Law

Kabita Sarkar began her legal career after graduating in law from Hooghly Mohsin College. Starting in civil cases at Alipore court, she gradually shifted to criminal law. In February 2023, she joined the South Asian Legal Services Association (SALSA), where she focused on criminal defence. By June 2023, Sarkar had moved to Sealdah court, continuing her work in criminal law, which has now led her to this high-profile case.

According to reports, Kabita Sarkar took this case based on her strong belief in justice being served through a proper court trial, rather than through pre-trial public judgement. She is determined to ensure that her client receives a fair defence. Sarkar has requested the assistance of her senior, Sourav Banerjee, to help with the legal proceedings.

Sarkar is known for her opposition to the death penalty. She believes life imprisonment is a more just and effective punishment, as it provides offenders the chance to reflect on their crimes. The case involves the shocking rape and murder of a 31-year-old postgraduate trainee doctor at Kolkata’s RG Kar Medical College on August 9, 2024. The victim was found in a semi-nude state, and Sanjoy Roy, a hospital staffer, is accused of the crime. This case has caused national outrage, and the Central Bureau of Investigation (CBI) is conducting an intensive investigation. The autopsy has revealed disturbing details, further intensifying the public’s demand for justice.
