Over the last few weeks the Uttar Pradesh Real Estate Regulatory Authority (UP RERA) has issued several orders to safeguard the interests of homebuyers. The developers were offering conditional possession to homebuyers, stating that flats should be handed over only after all the amenities that are promised in the sale agreement are ready. They were warned for the same. The regulator of the state real estate has also said that a unique QR code will be assigned to each new project during registration and promoters need to upload them in their brochures.

With the goal of establishing transparency in the real estate market, UPRERA has stated that a unique QR code will be assigned to each new project during registration and promoters on its way to upload them in their brochures and advertisements.
UPRERA has made this thing very compulsory for the promoters to publish project QR codes in all documents shared with the allottees such as allotment letters, booking forms, BBAs.
At times home buyers don’t get the access to verify amenities and other information of projects and have to solely rely on advertisements done by promoters.
It was said in the statement that any desirous who wants to make investment in a project can easily scan the code, acquire all the details of the projects from the portal of UP RERA and verify the information about the projects forwarded by the promoter in the advertisement.

Promoters must make sure that in all types of advertisements and promotional materials, including print, electronic, digital and radio of a project, the RERA registration number of the project, its QR code, information of project collection account number and RERA portal are mentioned intelligibly.
Realtors are directed to offer possession of housing units only after all the amenities that are promised in sale agreement are ready
Uttar Pradesh real estate regulatory authority has stated that real estate promoters use manipulative homebuyers to take possession of housing units on terms and conditions which are not mentioned in the original sale agreement.
It said that it had obtained several complaints from homebuyers that they have been forced to sign possession letters even though amenities and services that were promised in the sale agreement were not ready.

The regulatory committee has obtained complaints from allottees that promoters are offering conditional possession of units on the basis of agreements and forced them to sign it. This declaration differs from the Agreement for Sale and is illegal because it consists of conditions that limit allottees to function their legal rights in the future.
Sanjay Bhoosreddy, chairman, UPRERA said that complaints possession of units on the basis of conditions have been obtained. This act by the promoters is against the principle of natural justice and are the objectives of the RERA Act.
He added that promoters should sell flats only based on flats and approved maps, layouts and give possession without diverging from the terms of the Agreement for Sale so that the allottees are not feeling betrayed and dissatisfied.
Promoters are warned that projects will be included in ‘abeyance list’ if they fail to publish land records or maps on the portal
To protect the interests of homebuyers, the UP RERA stated that promoters from 400 group housing projects in Uttar Pradesh have been warned of including them in ‘abeyance list’ after the failure of uploading the land records or maps in its portal occurs.
The regulator stated that after a brief investigation of the records of the projects that are registered with UP RERA, it was observed that the promoters of around 400 projects have not published the project map and land ownership or one of them on the RERA portal. It was during the early days of RERA when these projects were registered by the promoters. The warnings were continuously passed to the promoters since 2018 to upload all the documents of the project on the portal.
It stated that this decision has been taken with the objective of changing the allottees and protecting them from being defrauded by such promoters.
