On Monday, the apex court of US refused an effort by the Republican Attorney General of Missouri for lifting the gag order and to delay the sentencing of Donald Trump who’s former president after his conviction in the New York Hush Money case.

Gag order infringes the voters right:

This decision of the court came as a response to the lawsuit of Missouri’s claiming that the case of Trump had infringed on voter’s rights under the Constitution of the US to hear from the Republican Presidential nominee who seeks to be the president of the US for the 2nd time.

Bailey who’s the Attorney General of Missouri who wanted the order to be stayed until after the election which wrongly limits the GOP presidential nominee can say and also the conviction of Trump would eventually affect his traveling.

Charges are politically motivated:

Bailey also said that the charges are politically motivated as he said that it’s a conflict between two states. The Supreme Court hears appeals but can also act as trial courts in case of State-conflicts. However, those disputes usually deal with shared borders or rivers that cross state lines.

New York’s side:

New York had said that the limited gag order allows Trump to speak about the issues which are important to voters and the sentence might not affect his movement.

Letitia James who’s the democratic attorney general argued that the appeals are made through state courts and there’s no state conflict which allows the Supreme Court to look upon

Gag order on Trump:

Trump is in a gag order which was imposed at a trial after the prosecutors had raised concerns about his habit of targeting people who are involved in his cases. However, the order was changed after his conviction which allowed to speak publicly about the witnesses and jurors.

The Case under which Trump is convicted:

Donald Trump, a former president and current presidential candidate from the Republican party was convicted in Manhattan and known for the ‘Hush Money’ case. He was convicted on the counts of falsifying records of business which arose from what the prosecutors said was a bid to cover up a hush money which was paid to porn star known as Stormy Daniels just before the US presidential polls of 2016. She claimed to have a sexual encounter with him which has been categorically denied by Trump.

The charges under which he is convicted would lead to imprisonment by 4 years but it’s not clear whether the prosecutors would seek prison time as it would be rare-punishment for a first-time offender. Other sentences could include a fine or a conditional discharge which would also require Trump to stay out of the troubles in order to avoid any additional punishment.

However, Trump is also attempting to overturn his conviction citing the case verdict of the July ruling of US supreme Court which gave them immunity from being prosecuted as a former president in a case related to election interference while ending the possibility of him facing trial.

The 2024 presidential elections will be held on 5th November.
