Supreme court plea of Arvind Kejriwal challenging the high court’s stay on interim bail order has been withdrawn

The final order passed by the Delhi High Court confirming the stay of his bail in the excise policy case ED will be challenged by Delhi Chief Minister Arvind Kejriwal.

On Wednesday, in a strong move, Chief Minister Arvind Kejriwal withdrew from the Supreme Court his petition against the June 21st interim stay on bail ordered by lower court in connection with excise policy case saying he would file another plea fighting Tuesday’s final order from high court that confirmed this particular decision.A M Singhvi, counsel for Mr. Kejriwal, made a request for withdrawal of the petition before a vacation bench comprising Justice Manoj Misra and Justice S V N Bhatti who not only allowed it but also dismissed it as withdrawn.

“Every day we are overtaken by events. The judgment came which had all sorts of issues and one remarkable point….”Your Lordships have given leave and granted us liberty to apply for bail while saying in which you have left open question whether your High Court orders were binding or not” submitted Singhvi.

“We were arrested yesterday after undergoing CBI interrogation and detention under PMLA 2022”.“Having said that, I don’t think I’ll have any alternative but to proficiently challenge this with all available grounds on a proper SLP.

Therefore, I submit myself to your lordships’ pleasure to withdraw but with the liberty that first, I already have before Your Lordships an application challenging your order of 21st June and secondly, therefore now, the order of 25th June is more important,” Singhvi submitted.However, additional solicitor general S V Raju representing the Enforcement Directorate argued that Kejriwal could only challenge the June 25 order not the June 21 order.

“My friend gets a stay application and I can’t challenge!?” objected Singhvi.The bench disposed of plea allowing Singhvi’s request.

On June 21st Justice Sudhir Kumar Jain of Delhi High Court stayed until “two-three days” the bail granted by trial court to Kejriwal. He was arrested by ED on March 21 in the money laundering case connected with another excise policy case which is being probed by CBI separately after this Mr. Kejriwal went to Supreme Court against HC decision.Also he was arrested by CBI in excise policy scam case today..
